Ed-vise: 31 Counts

A Nuggets Win GOOD MORNING!!! to you all! Yup, Denver did it! Took the NBA Championship in 5 games. Not bad. I will give credit to the Heat. They put up a hell of a fight. Best series I seen in a while.

Technically Talking Tuesday Ed-vise today. Cause it’s TUESDAY…Technically!

T-Rump indicted…AGAIN!

This time though, this is going to be a problem for the Draft Dodging Coward.

The first one out of Manhattan, that’s going to be tough. I mean politicians pay off people all the time. Doesn’t make it right. But, they do. Then they lie about paying people off. Amazing that this is our system of government.

This time…it’s a subject that is near and dear to my heart because, at one point, I was denied (temporarily) a security clearance. And this ass clown gets the top security clearance…but then screws that up. So, I will do my best to keep my emotions out and give you the Technical side on the indictment.

First, this is a federal indictment. Meaning the people of ALL the United States said “you committed a crime.” Or 38 crimes in T-Rumps case.

Versus the Manhattan one which is a State of New York thing.

Today, they will bring him into the federal court house in Miami and read the indictment to him. He will probably plead Not Guilty to all 38 charges. Then, trial will get set for sometime in the future. The feds could probably do it tomorrow but they will give T-Rump time to hire an attorney and prepare a defense. Rumor has it he is having a hard time finding someone that wants to represent him. Nice!

When it comes to indictments, the prosecutor has to catch everything. They only get one shot at indicting someone on something like this. The first 31 charges relate to individual documents. Each document being retained by T-Rump, when he should have given them back, is an individual violation of law.

Could the prosecutor have done one charge for 31 documents? Yes. But, if he screws up on the case, and loses, all 31 documents are cleared at one time. By doing the charges this way (each document is a charge) the prosecutor has the potential to take 31 shots at getting a conviction. Each individual charge has a fine or 10 years in prison price tag.

Thus, if the prosecutor engages in negotiations, they start from the notion of the defendant faces up to 310 years in prison. If they had done all 31 under one charge then the position is the potential of 10 years in prison.

Second thing to understand on this indictment is the fact that it was a Grand Jury, that agreed with the prosecutor to go forward on this. Basically 12 people said there is enough evidence here to bring legitimate charges against T-Rump. The prosecutor drafted up the charging instrument and presented it, along with the evidence, to the 12. So, when critics want to make the prosecutor out to be a bad person, keep in mind that 12 average people said “go get that son of a bitch!” Not literally but, that’s what I would have said.
