Well, T-Rump was found GUILTY!
34 felony counts of falsifying business records. One count for each second he had sex with Stormy Daniels.
And the “Fake-riots” are pissed! Showing off their “Tacti-cool” shit and ammo mags. Their guns and all the other bullshit they like to show off with. At least that is what shows up on the social media threads.
They claim they will rise up and overthrow the existing government to restore the Constitution. Because they think T-Rump was denied his Constitutional rights.
OK, let’s break that down and I will keep it professional so that you, my initiated readers, can engage in a thoughtful and logical debate WITHOUT making it a name calling and hurtful event.
Putting aside the debate about how the Constitution applies to the states, we dive into the various articles and amendments surrounding the recent decision.
Article 3, Section 2 tells us that the trial for all crimes shall be tried by jury and in the state where the crime occurred. Here, crime occurred in New York and was tried by a jury. No Constitutional issue here.
Then we dive into the amendments.
There was a lot of bitching going on about the 1st amendment. That one was is about free speech and doesn’t apply because he wasn’t on trial for his speech.
Amendments 4, 5, 6, 7, and 8 are the ones in play with 8 coming up.
4 deals with search and seizure.
5 deals with having a grand jury do up the charges and against self incrimination. T-Rumps Circle of Idiots use it all the time whenever they are brought in for questioning. T-rump had a grand jury that brought up the indictments. He did not have to testify. He sat there and gave stink eye to everyone. No issue here.
6 deals with speedy trial and witnesses and being able to bring forward witnesses that are favorable to your defense. This happened. The prosecution brought out their witnesses and he brought out his. Even though he claimed it was all rigged, it was up to his attorneys to prove it. They didn’t. Trial happened fast. Witnesses made their statements and the jury believed them. Tough break, no issue.
7 deals with civil suits and the right to a jury. Doesn’t really apply in a criminal case but it is another aspect of the Constitution that T-Rump has not been denied. He and his AWFUL lawyers simply never take advantage of it. See the E. Jean Carroll case.
And then there is Number 8: Cruel and unusual punishment. That has to do with the sentencing.
Each of the felony counts has a max penalty of 4 years behind bars. The judge will pass the sentence. It does not have to be 4 years. It can be whatever the judge comes up with. But, it MUST be something.
My prediction: T-Rump will NOT go to jail. Nope, just won’t happen unless Congress passes some sort of law. And we know that won’t happen.
T-Rump won’t go behind bars because the burden on the New York Prison System will be HUGE! All because of the Secret Service Protections provided to former presidents and their families. Thus, he won’t go to Ryker’s Island.
Despite the disdain and lack of respect T-Rump showed the court, the judge won’t order him locked up.
However, I can see the judge ordering T-Rump to “house arrest.” Meaning T-Rump would have to stay in his Trump Tower Condo that is worth way less than he tells people. I can see him only allowing T-rump the same time on the phone as any other prisoner. I can see him limiting the number of visitors he is allowed. Basically setting up Trump Tower as T-Rumps own, personal Ryker’s Island.
And that would be cool for me.
Here’s the last point for the upcoming family debates around this whole thing. T-Rump has, literally, HUNDREDS of felony charges against him. H-U-N-D-R-E-D-S! Do you think that maybe, just maybe, he did something wrong?
