Gonna talk a bit about the immigration thing and civil rights. So, get your coffee and put your Learnin’ Hat on!
I’ll start from the position of if you break the law, you break the law.
Thus, if you came across the border without following the procedures of entering the country, you broke the law.
I’m not saying you are a bad person or any other derogatory statements. I’m pointing out you did something incorrectly.
Now the other side of the coin.
In this country, you, me, us…WE are presumed innocent until proven guilty. Plain and simple. It isn’t specifically in the Constitution. However, the prosecution has the burden of proving that you broke a law.
Which now creates the question: How do you know someone has illegally come into this country?
You’re standing next to someone in line at the coffee shop. No words are exchanged. They look at the menu, just like you do, then back at their phone. You heard that people from other countries have entered the country illegally. How do you know this person in the coffee line isn’t one of them?
Then, imagine they are asking themselves the same question of you.
For our scenario, ICE walks into the shop and starts demanding to see driver’s licenses and proof of identification.
I’ll bet you everyone reading this will reach into whatever is holding their license and pull it out, no questions asked.
Anymore…I will not. And yes…I know what I wrote.
My reasoning: what purpose are they asking me for my license? I’ve done nothing wrong. They have no probable cause to ask me for my identification. Why do I need to provide it to them? PLUS: how do I know these are actual ICE agents and not some Cosplay Characters?
Alabama, Arizona, Florida, Kansas, Missouri, Nevada, North Dakota, and Ohio all have “Stop and Identify” laws. Oregon does not. Meaning Oregon folks do not need to provide ID when not driving. The federal government (ICE) does NOT have “Stop and Identify” laws.
4th Amendment in the Constitution is for unreasonable search and seizure. That means the police need probable cause to ask for your information. So, back to the question: How do you know a person is here illegally?
The answer: we don’t.
Straight up. We do not know someone is here illegally.
This immigration thing impacts us all. Everyone at every level. Reason being is ICE is walking up to people just because of the color of their skin. They are asking for ID. Even if these people produce ID, ICE is ignoring it. Then, ICE takes them in and holds them for at least 6 hours in a detention center.
So when I say this impacts us all, THINK ABOUT IT. HOW will you prove you are in this country legally? Especially if the ICE agent refuses to acknowledge the ID you produce.
I only ask that you keep this in mind: this immigration thing impacts us all! Especially in these dark times.
