Anyway…
TEXAS (God bless Texas)! Re-think this abortion thing. Seriously. Rarely do I issue a directive like this. However, if you are a raving civil rights whatever, either left or right, you need to re-think this measure.
See, right now, the US Constitution applies to all the states. It wasn’t always that way. In fact, it was really written as a document about federal action and leaving it to the states to decide what they wanted to do.
Now, this little abortion issue has been set up, by Texas, to not criminalize abortion. By not making abortion a crime, the State does not enforce it. That removes the “State Actor” piece which is a mandatory requirement to have State encroachment on a civil right.
Instead, Texas allows a civil cause of action. Meaning it has created a path for it’s citizens to enforce the law. Thus, no State Actor. Plus, no fines or crime issues.
That’s for abortion.
Now, picture this all you “Do Gooders.”
Any state (pick one) passes a law that says “If anyone approaches another person, without that person’s consent, and promotes ANY religion, any person in the State may file a civil suit against that person for a minimum of $100,000.”
The state didn’t criminalize the action so, no State Actors. Only created a cause of action in a civil court.
Basically, name the civil right, remove the criminal element and allow the people to enforce it in civil court and BAM! You start removing all those protections you love so much.
TEXAS (God bless Texas)! You need to rethink this because California is going to do the same thing with guns.
