A broke in the new BBQ last night GOOD MORNING!!! to you all! Yup, cooked up the first batch of many steaks. Pretty good, easy to light, no burned hairs on the back of my hand! Not too bad. First night I’ll give it a B. Always room to improve.
Technically Talking Tuesday Ed-vise today. Cause it’s TUESDAY…Technically.
I wake up to the headlines that a Supreme Court decision has been leaked. Barricades are currently being set up on the court steps for the protests that are coming and the decision HASN’T BEEN MADE FINAL! It was a DRAFT of an upcoming decision.
The opinion relates to abortion. Politico managed to obtain a copy of the draft and let the world know about it. That means that a clerk at the Supreme Court committed a really big ethics violation. Criminal? No. Ethical issue? ABSO-FREAKIN-LUTELY!
See, when it comes to these decisions, the judges listen to and read the legal briefs submitted by both sides of the argument. Then, the judges go to a chamber room and debate amongst themselves how to decide. After a bit of discussion and yelling, they vote. Along with the vote they decide who will write the opinion of the justices. Many times you will have a person for the majority AND a person for the dissenting group (minority).
They then hand it over to their clerks who track down the supporting case law and write up the opinion. Once done, they hand the opinion over to the judges who read it and, if they decide to agree with it, they do or they add to it.
OR…they change their mind.
The opinion relates to abortion.
Now, EVERYONE who knows how the court is made up KNOWS that this Supreme Court WILL overturn Roe v. Wade. Notice I said “WILL.” The judges were put in with THAT as a specific purpose. That is why the conservative majority ALL are members of the Federalist Society.
Leaking the opinion though, that is a problem in the legal world. And in the regular world as we are seeing. With the leak of the opinion, you can already see the people rising up to apply pressure to the judges. Basically the “Mob” attempting to change the mind of judges who are supposed to be un-influenced by the Mob.
But, more importantly: trust has been broken. The leaking of the draft shows it. The politics of the judges makes no difference.
See, judges talk amongst each other about the issues of the case. Furthermore, they talk among themselves and among their clerks about evidence in the case that has been submitted under the protections of secrecy. Meaning the evidence does not get spoken of.
The judges have a tremendous amount of pressure to decide on cases. They take counsel from one another to help each other bare this burden. Those conversations are NO LONGER PRIVATE. Why? Because the trust has been violated. A justices clerk has leaked the thoughts.
It is difficult to put in words what this leak has done. Congress leaks all the time! I’m OK with that. Seriously. The Supreme Court, well, technically, was supposed to be better than this. Now, they can enjoy the barricades and bonfires!
