Ed-vise: Rights

A later day GOOD MORNING!!! to you all! Yup, an early morning meeting kept me off schedule this morning. No big. It’s the showing up that counts!

Think About it Thursday Ed-vise today. Cause it’s THURSDAY! Time to THINK!

I have said it before and I will say it again: It is NOT the job of ANY court to PROTECT YOUR RIGHTS!

The court system was NEVER supposed to protect rights. If you want rights protected it is YOUR responsibility to protect those rights by having the codified into law!

Take a recent opinion by the Supreme Court regarding a convict sentenced to death row and their ability to appeal to the Federal Court of Appeals to look at what the state courts did not look at. Even if the convict was innocent.

6-3 decision the court said that a federal appeals court should NOT take up a post conviction appeal and look beyond the evidence presented to the state courts.

In an nutshell, Prisoner was sentenced to death by the state of Arizona. He appealed to all levels of the Arizona appeals process. As is required by law and by the separation between federal and state powers. No problem.

He lost on all levels.

Then, he appealed to the federal side of the fence. During those appeals he brought up ineffective assistance of council. That means his lawyer sucked. The federal appeals court took it up, and sided with Prisoner. No more death row.

Arizona appealed that to the Supreme Court. And the Supreme Court said the Federal Appeals Courts had NO BUSINESS expanding the evidence to encompass shitty lawyers. Why? Because PRISONER never brought it up to the state courts. AS IS REQUIRED by FEDERAL LAW!

And the news is losing their minds about prisoners being denied the right of appeal for death row convictions.

Prisoner is fighting to keep the right to live. He is relying on the court to protect this right. Well, if the death sentence were removed as a penalty in Arizona, Prisoner would not have to worry about being put to death. His “Right” to live would be codified in the state statutes. Further, if Prisoner wanted the right to “Effective Council” he would codify it in the state statutes. By doing so, the courts would be BOUND by what the LAW says!

Do NOT rely on a judge to PROTECT YOUR RIGHTS! You want “rights” get them put in your state statutes. Otherwise, you are simply hoping.
