Think About it Thursday Ed-vise today. Cause it’s time to Think About It
Texas or Taliban; Taliban or Texas…which one shall we think about? Hmmm. Think, think, think.
Texas. (God Bless Texas) That squirrely little red haven of hate. My goodness that legislature goes out of it’s way to please it’s hypocritical evangelical community.
Passed themselves a bit of legislation to make it more difficult to obtain an abortion except in the situation of a medical emergency. Notice that the “Rape and Incest” lingo is indeed missing from that law. So, ladies, if you was raped or impregnated by your family…too bad. AND, most likely, that baby will NEVER be aborted. Why, because if it is, the father (rapist or family member) can sue everyone that took you to the clinic for a MINIMUM of $10,000. MINIMUM says the law. Along with attorney fees and costs. Wonder if Texas Republicans saw that part (God bless Texas).
Another little part…and here comes the Think About It action!
The law makes it clear that no state official shall enforce the law. No DA or prosecutor; no admin judges. Basically the State of Texas wants to make it seem that the State is not the actor enforcing the law. The way the Courts look at stuff is you need State Enforcement to have a civil rights claim. Which this issue is. By having the commoners (that’s non-state type people) enforce the law through civil actions, you create a grey question of is the State violating civil rights. OK.
If that’s not enough thinking…try this: In order for a case to proceed in court you need a clerk (state employee) to file the case. Since the law prohibits state involvement in enforcement, that would mean that state employee CANNOT file that suit. You could arguably make the case that the courthouse itself would be off limits to such a suit.
See, if tax payer dollars are involved in enforcement of this law, then you end up with a case for state enforcement.
Rather than playing fuck fuck games with a woman’s rights, or allowing rapists to impregnate their victims, maybe Texas should simply read their bibles and put into practice What Would Jesus Do.
