Technically Talkin Tuesday Ed-vise today. Cause it’s TUESDAY! Time for some tech.
OK. I been watching Yellowstone lately. Why? Cause I’m not sure I like it. I like Costner. I like the individual characters. The scenery is awesome even if a bunch of it was shot in Utah and not Montana. Plus, my summers were spent on a ranch so I kind of relate to some of the work they do.
My problem comes from the Dutton family making more problems for themselves than they have to! Plus, there are some legal issues that just give me problems because they are not right!
Which brings up today’s Technically Talkin’.
In the show there is an issue about Power of Attorney. John (Costner) signed PoA and supposedly gave this to Beth (Kelly Reilly). Jamie (Wes Bentley) at one point did something and somehow made himself PoA. I cannot recall if John saw this or approved it.
Then, when it came to a point of contention, Jamie told Beth that because she filed it in Utah, it was invalid. Huh?
Utah and Montana both participate in what is called the Uniform Power of Attorney Act. That act recognizes PoA between these and several other states. So it would not matter where they PoA was drafted or filed.
Second, since John is still of sound mind, he could write on a cocktail napkin that he “revokes any and all PoA that Jamie might have now or in the future to the Yellowstone Ranch.” Too easy.
See, PoA is a safeguard for when you are not around or not able to take care of your day to day business and/or personal affairs. It allows another to stand in your place and conduct business on your behalf. 99% of the time they are drafted SPECIFICALLY to avoid your designated representative from doing things like Jamie did: conducting business behind your back.
The Market Equities Group should have been WAAAAAYYYYY more diligent in their legal work to recognize this issue.
I’m not saying I will stop watching the show. I’m just pointing out bad lawyering.
