The question was brought up by Justice Kavanaugh in the case from Mississippi that is believed to overrule Roe. I say “believed” because the draft opinion is NOT the final judgment!
Kavanaugh asked why the court should be the decision maker on the topic of abortion rather than the states and the people.
Great question! And I am not a fan of Kavanaugh! Still, a great question. Even though, from state to state, the people will decide differently, why shouldn’t the people of the states decide this issue?
Then, I observed some of the talk show type people and arm-chair Constitutional scholars give their opinion. Mostly wrong and misguiding.
The big one that seems to carry the most talk pushes back with a question of “does my womb change from state to state.” My opinion, not the best way to articulate the notion of consistency. Basically, the talking heads wanting the same law across all 50 states.
OK, fine. I can get behind the same law in this matter for all states. I can also advocate for each state having it’s own laws in such a matter.
In either case, the Supreme Court DOES NOT MAKE LAW! The State Congress does as well as the Federal Congress make law. Laws are made BY THE PEOPLE through their elected officials. NOT BY THE COURTS!
Thus, I MUST state again: GET OUT AND VOTE! Get on the phone to your representative and make them DO THEIR JOB!
The anti-abortion group is AGGRESSIVELY doing this and mobilizing their people to ban abortions. Emphasis on AGGRESSIVELY.
If you want the right to choose along with the right to marry or have your kids educated or whatever, you MUST VOTE!
Hoping the Court will create or protect your rights is a FOOLS ERAND! VOTE! VOTE! VOTE!
